I’m tearing my hair out over this renewal! My landlord just sent a rent-stabilized renewal and there’s a whole separate line for a heating system maintenance charge added on top of the base rent. Heat has always been included in my lease, and now they want it as a separate monthly charge under additional rent. It’s not folded into the legal rent, it’s literally a new line! I’ve never seen this in a prewar building. Has anyone else dealt with a landlord trying to unbundle heat and call it a fee? Will the DHCR count that as a rent increase or is it some junk fee I can refuse?

Wait, heat included but they want a separate maintenance charge? That sounds sketchy. I’m new to NYC renting so I don’t totally get rent stabilization. How do you even check if your unit is stabilized? I always thought boiler maintenance and heat just came out of the rent. Did the landlord say why they added it?

Nah, if you’re rent stabilized and heat was included, adding a separate charge for the same service is a rent increase by another name. They can call it a maintenance fee, but mandatory is mandatory. I’d check your old lease and the DHCR registration. If heat is registered as included, they can’t just start charging for it during renewal. Tell the managing agent to kick rocks.

Yeah they pull this when they think people won’t read the renewal. If it’s collected with rent and not tied to extra service, it’s rent. NYC doesn’t care what label you put on it. Check the registration and send a written dispute. If it’s not in the old lease, I wouldn’t sign until it’s removed. Keep everything in email.

Thank you! I pulled my last lease and the only extra line was the standard window guard rider. No heat charge. I found my building registration on the DHCR site too — that thing is buried! — and it lists heating as an included service. So can they add a new charge just by putting it in the renewal? I’ve heard of legal regulated rent and preferential rent but not this. Have you tried calling the DHCR rent hotline or is that just a day on hold?

Don’t bother with the hotline yet. Email the landlord or managing agent and say you won’t sign a renewal with a new separate heat charge because it contradicts the lease and the registration. Get it in writing. You can write 'signed under protest' if you do sign, but better to make them remove it first. If they collect it anyway, that might be an overcharge and you can file later.

Classic move. They add a fee because the RGB increase felt too low or they figure nobody will push back. With rent stabilization, the monthly charge has to be on the renewal form. A new separate charge needs a rider or some kind of approval. Not a lawyer, but I’ve had to explain this to a landlord once. Ask for the rider and the order that allows it. No order, no fee.

So if I don’t sign, they have to send the renewal without it? I had a landlord try a boiler fuel adjustment once and I didn’t question it because I was new. Does the DHCR site really show what services are included? This is super educational, thanks. I’m going to check my own registration now.

Yep, DHCR rent history and registration should show the service list. If heat is registered as included, unbundling it is a service reduction dressed up as a fee. Don’t let them frame it as maintaining the same system because that’s what your rent already covers. Also ask around your building. I bet other people got the same renewal and didn’t notice.

Okay I talked to the super and he said it’s just the new managing agent. But the super isn’t the landlord and he didn’t have any paperwork. I emailed the managing agent and specifically asked for the rent stabilization rider or DHCR order that lets them add a separate heating charge. Nothing back yet! This has to be an illegal pass-through, right? I also found the service listed on the registration with no separate fee. Should I file an overcharge complaint now or wait until they try to collect the first renewal check? I’m ready to fight this!!

Don’t file an overcharge complaint if they haven’t collected anything yet. Send a letter by certified mail saying you dispute the renewal clause, and you’ll sign only if the legal rent stays and the heat charge is removed. If they insist, then file. And if you pay rent separately, write 'rent only, no heat fee' on the memo. They might cash it, which actually helps show you were paying the legit rent.

Also check the renewal is on the right stabilized form. I once had an agent send a regular lease renewal with a fee buried in it. If they want extra money they need to show the legal path. Get the owner’s address from the registration and send your dispute to them too, not just the managing agent. You’re doing the right thing.
